Alabama window business accused of scamming customers; state looking for more victims

Alabama Attorney General Steve Marshall secured a restraining order against Legend Windows, LLC saying the business tricked customers into making deposits for new windows and doors but failed to deliver the products.

The temporary restraining order was granted by the Circuit Court of Shelby County and also includes individuals affiliated with the business, Jody Ray Whitworth, Bobby Ray Whitworth, and Robin Simmons Willard. The order includes an asset freeze and prevents the business from operating while the courts review the matter.

“Legend Windows and the Whitworths have run this scam for far too long, preying on their customer base, and it’s time that they are held accountable for their crimes,” Marshall said in a news release. “The Defendants have a track record of property theft and have shown no remorse for their fraudulent actions by perpetuating their transgressions over and over.”

According to the state’s complaint, the company violated the Alabama Deceptive Trade Practices Act 42 times with over 40 known victims across the state who are owed a total of $181,042.80 in damages.

Jody Whitworth allegedly used customer payments to make personal purchases instead of providing the products and services the business advertised.

Between September 2022 and March 2024, the Legend Windows bank account made over 1,100 purchases from Amazon totaling around $50,000, according to the news release. The business also made over $20,000 in purchases from Temu, Etsy, JCPenney, TJ Maxx, Ross, Marshalls, Scentsy, Plato’s Closet, Nordstrom, Kohl’s and Burlington.
