AMC Entertainment Loses Bid to Take Privacy Suit to Arbitrator

Consumers’ allegations that AMC Entertainment Holdings Inc. illegally shared the movie-watching information of online ticket buyers with Meta Platforms Inc. will be heard in federal court rather than before an arbitrator.

Plaintiffs Jasmine Bretto and Naomi Kopinsky weren’t bound by a mandatory arbitration provision in the AMC website’s terms and conditions because the site didn’t give them reasonably conspicuous notice of the terms, Judge Daniel D. Crabtree of the US District Court for the District of Kansas said Tuesday.

Crabtree denied AMC’s motion to compel arbitration, but granted its request to withdraw its motion to dismiss without prejudice to refiling. …
